I’ve listened to enough 5-4 pod to know that this will almost certainly be how they do it. That said, it’ll be interesting to see if they take a Roberts 2 step to get there or just jump straight to the xenophobic ruling this time, now that Trump will be able to effectively make an even more unbalanced judiciary with nothing to lose this time.
